Terms and conditions

1. About these terms
These terms apply when you use pnlstorm, a tool that helps you build a Profit and Loss Statement from figures you enter. By creating an account or using the wizard, you agree to them. If you don’t agree, please don’t use pnlstorm.
2. What pnlstorm does, and what it doesn't
pnlstorm turns the income and expenses you enter into a clear statement and a PDF you can give to your accountant, bookkeeper or anyone else who asks for one.
pnlstorm is not an accountant, tax agent, bookkeeper or financial adviser. Nothing in the app, including its examples, hints and calculators, is tax, accounting, legal or financial advice. Whether a cost is deductible, how it should be treated, and what you must report are matters for you and your registered tax agent or accountant, based on your own circumstances and the current rules of the ATO.
3. Your figures and your responsibility
Every statement is built only from the figures you enter. We don’t check them against your bank, your records or any government system, and statements are unaudited.
You are responsible for making sure the information you enter is accurate and complete, and for keeping the records that support it. Check the totals before you rely on or share a statement.
4. Calculators and examples
The calculators (for example for vehicle registration, depreciation, rent, power and phone costs) and the examples shown in the app are simple guides. They use straightforward methods and general assumptions, and may not suit your situation. Treat their results as a starting point and confirm them with your accountant.
5. Your account
You need an account to save drafts and keep a history of your statements. Keep your sign-in details secure and tell us if you think someone else has used your account. You are responsible for activity under your account. You must give accurate details and be old enough to enter a binding contract.
6. Your data
The answers you enter and the statements you create belong to you. We store them so you can come back to a draft and download earlier statements. They are tied to your account and are not shown to other users. You can delete a saved statement from your History at any time, and you can download a copy of everything we hold, or delete your account and all of your data, from the Your data page.
We use trusted third-party services to run pnlstorm, such as sign-in and database hosting, and they process your data on our behalf. We will not sell your personal information. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply.
7. Using pnlstorm properly
Please don’t misuse pnlstorm. That includes trying to break or overload it, getting around its security, using it to deceive someone with false figures, accessing other people’s data, or using it for anything unlawful. We may suspend or close accounts that do.
8. Availability and changes
We aim to keep pnlstorm running and accurate, but we can’t promise it will always be available or free of errors. We may change, add or remove features, including the lines, categories and calculators, at any time. Rules and rates change, so a hint or example that was right when written may become out of date.
9. Our responsibility
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that can’t be excluded, including consumer guarantees.
Subject to that, and to the extent the law allows, we are not liable for any loss or damage (including lost profit, penalties, interest, or the cost of a wrong tax or accounting outcome) that results from relying on figures, statements, examples or calculator results produced by pnlstorm, or from the service being unavailable. Where liability can’t be excluded, it is limited, as far as the law allows, to re-supplying the service or paying the cost of having it supplied again.
10. Ending your use
You can stop using pnlstorm at any time and delete your account and data yourself from the Your data page. We may suspend or end your access if you break these terms or if we stop offering the service.
11. Changes to these terms
We may update these terms from time to time. The date at the top of the page shows when they were last changed. If you keep using pnlstorm after a change, you accept the updated terms.
12. Governing law
These terms are governed by the laws in force in Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia.
